Terms & Conditions
These Terms & Conditions form an agreement between you and Echo Wave Innovations Private Limited ("Merchant", "we", "us" or "our"). Our registered or operating office is B-8, Sector- 2, Noida, Gautam Buddha Nagar- 201301, Uttar Pradesh, India. By creating an account, placing an order or using Echowave, you accept these terms. If you do not agree, do not use the service.
1. Eligibility and account responsibilities
You must be legally capable of entering a contract and must provide accurate, current account and billing information. Keep your login credentials confidential and tell us promptly about unauthorised access. You are responsible for activity under your account and for the prompts, files, references and other material you submit.
2. Service, orders and payment
Echowave provides the features, credit packs and memberships shown on the Product & Pricing tab. Prices, taxes, payment-provider charges and currency conversion fees are shown at checkout where applicable. An order is accepted when payment is confirmed. Refunds and cancellations are handled under the Refund & Cancellation Policy and any mandatory rights under applicable law.
3. Customer content and intellectual property
You retain the rights you have in your input and, subject to applicable law and third-party rights, in output generated for your account. You give us a limited, non-exclusive licence to host, reproduce and process your content only as needed to provide, secure and improve the service. You must have all permissions needed for content you submit and must not infringe another person's intellectual property, privacy or publicity rights.
The service, software, interface, documentation, trademarks, logos and all related materials belong to Echo Wave Innovations Private Limited or its licensors. Except as these terms expressly allow, you may not copy, modify, distribute, reverse engineer, resell or create derivative works from them. No ownership in our platform or marks transfers to you.
4. Acceptable use and availability
Do not use Echowave for unlawful, fraudulent, abusive, deceptive, harmful or discriminatory activity, to infringe rights, generate prohibited material, interfere with security, or bypass usage limits. We may modify features, impose reasonable limits and temporarily suspend the service for maintenance, security or legal reasons. We do not promise that generated content will be accurate, unique, complete or fit for a particular purpose; review it before relying on it.
5. Suspension and termination
You may stop using the service and request account closure by contacting us at support@echowave-india.com. Closing an account does not cancel amounts already due and may end access to unused credits or content, subject to the Refund & Cancellation Policy and mandatory law. We may suspend or terminate an account for a material breach, non-payment, misuse, security risk, legal requirement or if the service is discontinued. Where reasonably practicable, we will provide notice and an opportunity to remedy the issue. Clauses that by their nature should continue, including intellectual property, disclaimers, liability, payment obligations and dispute terms, survive termination.
6. Disclaimers and limitation of liability
To the maximum extent permitted by applicable law, the service is provided on an "as available" and "as is" basis, without warranties that it will be uninterrupted, error-free, secure or suitable for every purpose. We are not responsible for third-party services, internet failures, or content and instructions supplied by users.
To the maximum extent permitted by applicable law, Echo Wave Innovations Private Limited and its officers, employees and licensors will not be liable for indirect, incidental, special, consequential or loss-of-profit damages arising from your use of the service. Our total aggregate liability for a claim relating to the service will not exceed the fees you paid to us for the service in the twelve months before the event giving rise to the claim. Nothing in these terms excludes or limits liability that cannot lawfully be excluded or limited, including liability for fraud, wilful misconduct or rights that cannot be waived by a consumer.
7. Governing law and disputes
These terms are governed by the laws of India. Subject to mandatory consumer-protection rights, courts having territorial jurisdiction over the Merchant's registered office in the applicable Indian State or Union Territory will have jurisdiction over disputes. Before starting formal proceedings, contact us at support@echowave-india.com so that we can try to resolve the issue. Nothing in this clause prevents you from using a forum or remedy that applicable law makes available to you.
8. Changes to these terms
We may update these terms when the service, law or business changes. We will publish the revised version on this page, update the date above and, where a change is material, provide an additional notice through the service or to your registered email. Continued use after the effective date means you accept the revised terms.
